Welcome to Car Advert Check ("we", "our", "us"). By accessing or using our website (caradvertcheck.co.uk) and our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our service.

1Description of Service

Car Advert Check provides an automated analysis tool for used vehicle adverts. By entering a UK vehicle registration mark (VRM) and providing advert text or images, our system cross-references public data (such as DVSA MOT history) and utilises Artificial Intelligence to highlight potential maintenance risks, discrepancies, and negotiation points.

2Strictly Not Professional Advice (Scope of Service)

2.1 Information Only: Our service provides automated analysis based on the advert provided and third-party data sources. It is advisory and informational only, and does not replace a professional physical inspection, mechanical test, test drive, or independent comprehensive background check.

2.2 No Guarantee of Condition: AI analysis can be incomplete or wrong. We do not guarantee the vehicle's condition, safety, or legal status. A "Low Risk" score does not mean a vehicle is free from defects, and a "High Risk" score does not guarantee failure.

2.3 User Responsibility: You are solely responsible for any purchasing decisions. What our service does is aggregate and analyse data; what it does NOT do is provide a mechanical guarantee or warranty.

3Data Sources and AI Limitations

3.1 Third-Party Data: Our provenance data is sourced via third-party APIs (including the oneauto API), which aggregates data from sources such as the DVLA, Police National Computer, and finance/insurance registers. We pass this data through to you but we do not originate, verify, or guarantee its accuracy, completeness, or timeliness. Gaps in data or "unknown" results do not mean the vehicle is clear of issues. If the third-party databases are down or incorrect, our reports will reflect those inaccuracies.

3.2 AI Hallucinations: Our service uses Large Language Models (LLMs) to analyse advert text and predict maintenance intervals. While highly advanced, AI can misinterpret text, hallucinate facts, or provide inaccurate context. You must manually verify all claims, service intervals, and repair estimates provided in the report.

4Acceptable Use and Rate Limiting

You agree to use the service only for your personal, non-commercial vehicle purchasing needs.

You strictly agree NOT to:

  • Use automated scripts, bots, scrapers, or exploits to bypass our rate limits or access the API directly.
  • Submit maliciously crafted prompts or "Prompt Injection" attacks designed to manipulate our AI or bypass our security protocols.
  • Upload photos or documents that contain personally identifiable information (PII) of third parties without their explicit consent.

We reserve the right to immediately block your IP address and ban your account if we detect abusive behaviour.

5Payments, Credits, and Trust Shield

5.1 Credit-Based Pricing: Car Advert Check operates on a pay-as-you-go credit system. You may purchase credits via our payment provider (Stripe) to unlock premium features such as Trust Shield checks or report updates. Credits hold no monetary value outside of the platform and cannot be exchanged for cash.

5.2 Trust Shield Data Sources: Trust Shield unlocks data provided by third-party vehicle checking services. We act solely as an intermediary to display this information and make no warranties regarding the accuracy, completeness, or timeliness of the third-party data.

5.3 Digital Services & Refunds: By purchasing a report or credits, you are purchasing digital content. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you agree that we will begin supplying the digital content immediately upon purchase. You acknowledge and explicitly consent that by gaining instant access, you waive your 14-day right to cancel the contract and request a refund. If a Trust Shield API call fails to retrieve data due to an upstream error, the spent credit will be automatically refunded to your account balance. Manual cash refunds are strictly at our discretion and will generally only be provided if the service is fundamentally defective.

6No Relationship with the Seller

We are not a party to any vehicle sale, we do not endorse any sellers, dealerships, or platforms, and the transaction is entirely between you and the seller. Any disputes regarding the vehicle must be resolved directly with the seller.

7Intellectual Property

All code, branding, logos, and proprietary AI analysis logic associated with Car Advert Check remain our exclusive intellectual property. You may not copy, reverse engineer, or commercially distribute our interface or report structures.

8Limitation of Liability

8.1 Statutory Rights: Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

8.2 Scope of Liability: As our service is purely informational, to the maximum extent permitted by the laws of England and Wales, Car Advert Check and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, financial loss, or damages arising from purchasing decisions based on our reports.

9Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.
